Miller Disability Law, P.C.

Tennessee Disability Denials & Claims Attorney

With roughly 70% of all disability applications denied every year, it’s important for you to not lose hope. After an initial claim is denied, all applicants have the right to appeal the decision. There are multiple tiers to the appeals process, so patience is essential.

Having an experienced disability lawyer on your side helps immensely. We know exactly what the Social Security Administration (SSA) looks for when reviewing claims and appeals. We will help ensure all information is provided and sufficient medical records and other documentation are included.

    Step One: Reconsideration

When appealing the initial decision, we review your application and see what areas can be improved. We help you provide additional support for your claim, and establish your need for assistance due to your inability to work.

Step Two: Hearing with an ALJ

At this point in the process, you can request a hearing with an Administrative Law Judge (ALJ). This is a good opportunity to share your story and details personally to help the SSA better understand your situation. Additional information may be added to your disability case if necessary.

Your Social Security Disability attorney will help you prepare for this hearing. You will understand the process and what is expected of you. We will be by your side throughout the process, so you don’t have to go through it alone.

Step Three: Review of Hearing Decision

This step involves requesting a review with the Appeals Council to further explain and escalate your claim. The council will review the history of your case and the denials to this point. They may ask for further information or an explanation if anything is unclear.

    Step Four: Federal District Court

This is the last step in the appeals process. Most claims don’t need to go this far, but we are willing to go the distance. We are experienced in filing appeals at all stages, including advocating on your behalf in federal court.
