Why Work With a Social Security Lawyer in Pigeon Forge?

Applying for Social Security Disability (SSD) benefits isn’t easy. Many first-time applications are denied, even when a person truly qualifies. This is often due to a lack of supportive evidence or simple application errors. Having a Pigeon Forge Social Security lawyer on your side can help ensure that all paperwork is complete, your medical records are presented clearly, and your case is handled with care.

Our role as your attorney is to prepare your claim thoroughly and represent you throughout the process. We handle all the complex steps of preparing your application so you have a better chance of getting approved.

What Are Social Security Disability Benefits?

Social Security Disability is a federal benefit program that provides income to people who cannot work due to long-term medical conditions. These benefits are critical to maintaining financial stability for millions of Americans. For many families, SSD benefits can help with supporting essential needs such as housing, food, etc.

SSDI and SSI Qualifications

There are two main types of disability benefits: Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI).

  • Social Security Disability Insurance:
    • Based on your work history and the Social Security contributions you have made
    • You must have worked long enough and recently enough to qualify for SSDI
    • Designed for individuals who have developed a disability after years in the workforce
  • Supplemental Security Income:
    • Based on financial need, not work history
    • Helps individuals with limited income and resources who are disabled, blind, or 65 or older
    • You do not need work credits to qualify, but you must meet strict financial eligibility limits

Our experienced attorneys can evaluate your situation and determine which program you may qualify for.

General Qualifying Criteria

To qualify for either SSDI or SSI, the Social Security Administration (SSA) requires that:

Medical evidence is key. Our office works with you and your doctors to ensure the SSA has the appropriate records to understand the severity of your condition.

When To Expect Benefits After Disability Claim Approval

If your application is approved, your benefits will not begin immediately. With SSDI, there is typically a five-month waiting period after the official onset of your disability. This means that if you became eligible for SSDI in February, you won’t be eligible to receive your first payment until the sixth full month following (August).

The SSA pays SSDI benefits in the month after the month for which they are due. In the example above, you would receive your first SSDI payment in September.

Because most cases take several months or even over a year for processing, by the time a claim is approved, the waiting period may already be over. In these instances, back pay is distributed for any eligible months, minus the five-month waiting period.

For SSI payments, they usually begin the month after approval since there is no waiting period. You may be eligible for back pay with SSI, as well, but this only covers the months between your application date and approval date.

How Our Disability Law Firm Helps Clients in Pigeon Forge, Tennessee

Building Strong Claims

A successful claim often depends on complete medical evidence and documentation. We help gather medical records, coordinate with doctors, and submit up-to-date reports to strengthen your case. We also guide you in building non-medical evidence, such as symptom journals and statements from neighbors, employers, family, etc., about your condition.

From Applications to Appeals

Whether you’re filing for the first time or appealing after being denied benefits, we assist at every stage. That includes filing initial applications, preparing for hearings, and representing you in federal court if necessary.

Legal Representation at Hearings

If you must attend a hearing before an Administrative Law Judge (ALJ) during the appeals process, we will prepare you carefully. We will represent you in person, help you understand what questions to expect, and cross-examine vocational experts.

No Upfront Fees

We will bill you for the costs of medical records and expenses we incurred while preparing your case. However, attorney fees are only collected if your claim is successful and are taken from your back pay benefits. This way, there’s no significant financial strain during your case.

Compassionate Support

Our skilled attorneys and staff take time to listen and answer questions. We work to make the claims process clear and less stressful so you can focus on your health and daily life.
